USE OF THE SERVICE BY YOU:

The Service is not intended for users under the age of 18, and MyMercado.com, LTD., does not knowingly collect personal information from users under the age of 18. Information submitted by such users will not knowingly be used, posted, or retained by MyMercado.com, LTD., If you are a under the age of 18, you may use MyMercado.com, LTD., but only under the supervision of your parents or legal guardian. We reserve the right to refuse service, terminate accounts, remove or edit content in our sole discretion. Our services may only be used by individuals who can form legally binding contracts under applicable law.

It is free to register, buy and sell tangible items (goods) and intangible items (services) on MyMercado.com, LTD.

MyMercado.com may change to a Commission and Fee Policies at any time. Any changes to the policy will be posted on MyMercado.com, LTD., and will take effect within seven (7) days after notice is given on the site. As a registered user, you are wholly responsible for paying all applicable fees associated with using the services the site, and paying all applicable taxes associated with income received.

MyMercado.com, LTD., is only a venue for sellers to list their goods and services and for buyers to purchase such items. We do not transfer legal ownership of items from the seller to the buyer. We bring buyers and sellers together to sell or buy goods and services. MyMercado.com, LTD., is not involved in the transaction between the buyer and the seller, we just make it possible for these individuals to find each other. MyMercado.com, LTD., has no control over any listing or information that might be shared on the site. We also have no control over the truth or accuracy of the listings or services that are advertised and/or provided. MyMercado.com, LTD., is also not responsible for the seller’s capability in selling items or services as well as the capability of a buyer to pay for that item or service.

If you buy goods on MyMercado.com, LTD., you enter into a legally binding contract with that seller, and you are obligated to complete the transaction. You and the seller may agree to not complete the transaction, but if there is no agreement you will become the good’s lawful owner upon physical delivery of the goods to the buyer. Seller will still be charged a commission, unless they show proof of non-payment to MyMercado.com, LTD.

Bids are usually not retractable, unless there are extraordinary circumstances, such as:

• Clear error was made in the auction listing;
• Buyer and seller mutually agree
• Seller significantly changes the item's description after the buyer has bid on the item; and/or
• Buyer cannot authenticate the seller's identity

There is no fee for listing or selling goods and services on MyMercado.com, LTD.

You must be legally able to sell the goods or services that you list for sale on MyMercado.com, LTD. Sellers must describe their goods and services fully, and all terms of sale, including shipping and if there are any applicable taxes.

MyMercado.com, LTD., is in no way responsible for any of the statements made through any of our registered user’s web pages.

The seller is the retailer for sales tax purposes. The seller shall file all sales tax returns in accordance with applicable law, and each seller shall indemnify MyMercado.com, LTD., against any tax related to the sale of such seller's goods or services. If a buyer purchases a goods or services from a seller that resides in the same state, MyMercado.com, LTD., shall charge the buyer sales tax at the rate for the state within which such buyer lives, and such sales tax charged and collected shall be passed on to the seller.

If you use any of the services that are provided by registered users on MyMercado.com, LTD., we are not responsible for any disputes that might arise between you and the service provider. MyMercado.com, LTD., is a venue, and if you have a dispute with one or more users, you release MyMercado.com, LTD., (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

MyMercado.com, LTD., may suspend or terminate your account if we suspect that you have engaged in any form of fraudulent activity in connection with the use of the site. Buyers and sellers on MyMercado.com are prohibited from misuse of the bidding and selling process. You may not have other members bid on items for the purpose of raising the bid price. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead in any form. MyMercado.com, LTD., reserves the right to remove or edit such content. MyMercado.com, LTD., takes no responsibility and assumes no liability for any content posted by you or any third party.

Registered users are solely responsible for their information. MyMercado.com, LTD., only acts as a medium to connect the buyer and the seller. Information that is provided to us needs to be fully accurate. If MyMercado.com, LTD., discovers that the information given is false or fraudulent, that user will be terminated from the site. Please read MyMercado.com’s Privacy Policy in accordance with the User Agreement.

Registered users of MyMercado.com, LTD., are also prohibited from:

• providing false or misleading information about themselves or the products or services being sold or solicited;
• selling stolen or counterfeit goods;
• using obscene media (photos, audio, other);
• violating any laws in the United States or Internationally
• infringing on trademarks, copyrights or patents;
• threatening or harassing other members; and
• distributing any materials with any form of viruses, trojan horses, worms or any performance that will cause harm to other users

Referral Method – Paid on escalating scale, which is based on the number of people you enroll. Payments will be made on the 1st or 15th of each month, but only after member has been signed on for three months and MyMercado.com has received the final payment. The more people you sign-up the more you receive.

34-64 = 55% of plan of the person who signed up on MyMercado.com, LTD.

65-100 = 60% of plan of the person who signed up on MyMercado.com, LTD.

101-200 = 70% of plan of the person who signed up on MyMercado.com, LTD.

201-500 = 80% of plan of the person who signed up on MyMercado.com, LTD.

500 + = 90% of plan of the person who signed up on MyMercado.com, LTD.

Ex. You sign-up 30 people in the month on the Silver Plan ($19.95), that means that you get $598.50, which is 50% of the amount paid in the first month by the new members.

Members that are signed up, must stay signed on for a minimum of three months. If the new member gets out before that time, the referring member loses his commission. There is a one time payment to the referring individual, for each member that is completely signed on.

New Members must complete the following in order for the referral to be valid:

1. Complete registration process
2. Receive e-mail address from MyMercado.com, LTD.
3. Purchase a WebPage
4. Receive a MyMercado.com, LTD., URL designation
5. Completed credit/debit card payment

LTD (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

MyMercado.com, LTD and a registered user are solely independent contractors. No other relationship exists between MyMercado.com, LTD and the user.

You and MyMercado.com, LTD agree that any claim or controversy at law or equity that arises out of this User Agreement, Privacy Policy or our services shall be resolved through arbitration. Arbitration is a form of Alternative Dispute Resolution (ADR) in which parties choose an impartial third party to hear and decide the dispute. This arbitration hearing will be held in Bexar County, Texas or another location mutually agreed upon by the parties.

All content included on MyMercado.com, LTD., such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of MyMercado.com, LTD. or its content suppliers and protected by United States and international copyright laws. This Agreement shall be governed in all respects by the laws of the State of Texas as such laws are applied to agreements entered into and to be performed entirely within Delaware between Delaware residents.
